Dan O’Brien obtains Judgment against Financial Advisor in Fraud Case
In February 2018, Dan O’Brien obtained a final judgment in the amount of $720,000.00 against a financial advisor and registered representative of a securities broker dealer. After filing suit against the financial advisor in state district court on fraud claims, the financial advisor filed for bankruptcy protection. Mr. O’Brien’s clients sought an exception to the discharge based on claims of fraud, defalcation, and willful and malicious injury. To avoid trial, the financial advisor agreed to judgment and a finding that he had committed a willful and malicious injury against Mr. O’Brien’s clients, thereby precluding discharge of the debt owed to the plaintiffs.
